Moving from Secondary to a post-16 institution with an EHC Plan – Deadline 31st March 2022
Social Workers should make contact with the education provider to arrange the annual review of the EHC plan before a transfer to a post 16 institution known as a “phase transfer”.
The 31st March 2022 is the deadline for transfer from secondary school to a post-16 institution. Therefore, if not already done, it would be prudent to arrange the Annual Review..
The process is as follows:
Education Provider reviews the plan;
Sends proposed amendments and a copy of the plan (with section I left blank) to the Foster carer/ Social Worker;
Foster carer/ Social Worker; has at least 15 days to make representations about the proposed amendments/content of the plan and to either request that a particular school (from the list in section 38(3) Children and Families Act 2014)
LA issues a final amended plan, with notice of appeal rights, by the statutory deadlines in Regulation 18.
